The Texas Department of Health and Human Services (DHHS) has authored an amendment to the Texas schedule of controlled substances that removes hemp from the list. It is an extremely important step to have hemp declassified as a controlled substance. However, legislation would be needed to address consumer protection and regulation. Federal law explicitly authorizes states to engage in the state-authorized cultivation of hemp for research purposes. Over two dozen states have enacted legislation permitting licensed hemp cultivation in a manner that is compliant with federal law. We are excited to see Texas moving in this direction and supporting our agricultural community.

“To clarify, the legal impacts are still being discussed but it appears that this move makes hemp products already being sold legal and applies pressure to the legislature to create a farming program to submit to the USDA. The 2018 Farm Bill requires farmers grow under a state sanctioned program,” says Jax Finkel, Executive Director for Texas NORML.
